Bank of America was found to be within their full legal rights to not hire a woman under 12 USC Section 1289, as reported in a judgment article published in the New York Law Journal on May 25th, 2012.
After conducting a required FBI criminal history and background check on their potential employee, it was revealed that she had been arrested and charged with petit larceny. Although the woman had accepted an adjournment in contemplation of dismissal, she did not file the waiver of federal bar which would have explained her criminal charge. Furthermore, the law that the woman was charged with speaks directly to the characteristic of honesty. Under federal banking laws Bank of America was in their rights to not hire the woman.
